You are more than welcome to browse our website at your leisure, but there are just a few brief points to highlight regarding terms and conditions of website use. This includes using the search filters, browsing listings and contacting property owners or managers.

Privacy and confidentiality

Please refer to our Privacy and Cookies policy regarding any personal data which may be collected or provided.
Our procedures for storing information conform with the Data Protect Act 1988 and the General Data Protection Regulation (GDPR) applicable from May 2018. We are not responsible for the privacy practices of owners/managers and recommend you read their privacy statements prior to providing personal information.
We reserve the right to make changes to our privacy policies.
By accessing and browsing Accessible Holiday Escapes you confirm that you have read, understood and agree to this policy. If you do not agree with this policy you must not access the website.

Accessing our website

Our site can be accessed and contact made with property owners or managers at no charge.
You are responsible for accessing our site through your internet connection and for ensuring all parties who access the site through your internet connection are aware of these terms and conditions.
Our site may at times be temporarily unavailable.
Our site is provided for domestic and private use.

Changes to our website

We are able to amend or withdraw website content at any time.
We will update our website at times but are under no obligation to update content.
We cannot absolutely guarantee our site will be free from errors or omissions.

Use of our site for browsing listings or contacting owners/managers

Our website acts as a forum for listing properties. We do not act as property agents or as a travel agency and are not entitled to enter into agreements with holiday makers on behalf of the property owner or manager.
Agreements for letting of properties will be agreed with the property owner or manager and not through our website.
We are unable to become involved in any disputes between holiday makers and property owners/managers.
We are not able to deal with any complaints, these must be entered into with the property owner or manager.
We recommend you make contact with the owners/manager prior to booking or making payments for your chosen property, to ensure it meets your needs and to avoid disappointment.
We will endeavour to ensure listings are accurate and up-to-date, but we are dependent on information provided by the owner or manager. We make no warranties or guarantees that this information is accurate.
Our website content is provided for initial/general information only and is not solely information/advice upon which you should rely.
We do not personally visit or inspect properties.
We recommend that you take out travel insurance.

Our liability

We will not be liable to any holiday makers for any loss or damage, negligence, breach of duty or otherwise.
We are not liable for inability to access our site.
We are not liable for any loss, theft or injury suffered at a property listed on our website.
We are not liable for the lack of the property’s adherence to legislative requirements.
We are not liable for reliance on the content of our site.
We are not liable for instances of loss or theft due to online fraud.
We are not liable for any technologically harmful material that may affect your internet connection following use of our site.
We are not responsible for the content of the websites advertised on our site.
We do not enter into contracts with holiday makers.

Communication

When contacting us you are agreeing to receiving communications from us or owners/managers electronically.
If you fill in a contact form related to a specific listing you will be asked for your email address so that advertisers can reply to you directly. None of the emails or addresses are shared with any third parties.

Website content rights

We are the owners of the content of our website which is created by us.
You are able to print off or download information for personal use and can refer others to our website.
Visual images must not be copied without permission.
When our site contains links to other organisations or resources provided by third parties, these are provided for information only. We do not assume responsibility or control of these sites.

Applicable law

Welcome to our website, please read these terms of use before requesting to list your property/properties as they highlight your legal rights and obligations when advertising on our website. By advertising on Accessible Holiday Escapes you agree to be bound by these Terms and Conditions.

Information about us

We offer an online listing service for owners or managers of holiday properties and provide search facilities for users of our website.
We have no involvement in the booking of properties or transactions between owners/managers and holidaymakers. We may provide tools to enable contact between advertisers and users of our website.
The site is an advertising portal where you advertise your holiday property for a set fee for a period of one year, with no commission payable to us.
We do not offer advertising for a period less than one year but can delete your listing at your request before the end of the listing period. We are unable to offer refunds.
We reserve the right to carry out checks prior to activating your listing in order to take all possible steps to ensure all properties advertising with us are legitimate holiday properties and owners/managers. Owners must comply with these checks.

Placing your advert

Information you provide about your property will be held and used by Accessible Holiday Escapes to create a listing for you and will not be passed to any third parties. This includes property details, photos, videos and contact details of property owners or managers.
You must be legally permitted to let your property as a holiday rental and ensure your property is well-maintained/clean and information is clear and accurate.
We will take all reasonable care to ensure the listing is accurate based on all content provided by yourselves but are not responsible for any errors or omissions.
Content provided to Accessible Holiday Escapes must be original content and we reserve the right to amend content if it has been copied without permission. We reserve the right for the final edit of listings. You must own copyright to all images provided to us for your listing content, by paying your listing fee you are confirming you own copyright (this is stated on all invoices).
Once listing content has been approved and finalised in draft format and payment received, the listing will then be published live onto the website.
We recommend all owners/managers check their listing as soon as it ‘goes live’, an email will be sent to inform you of this, and a test email via the contact form will be issued.
No further major amendments or re-writing of a listing can be made once a listing is published live (a small number of minor amendments can be made during the listing period, i.e. change of contact, deleting out-of-date information, adding new images, etc). It is the responsibility of the owner/manager to approve all final content prior to publishing a listing live.
We reserve the right to use images provided to us for use within social media posts to promote properties and the website, and in alternative locations on the website (such as on the homepage as a main image or within featured links).

Price and Payment

Listings cannot be placed onto a live website without payment, an invoice will be emailed to you.
A one-off payment must be made for the advertising period of one year.
The price of advertising on Accessible Holiday Escapes will be displayed on our site. We reserve the right to amend our pricing structure.
Payments can be made by bank transfer or via Paypal.
An invoice will be issued approximately ten days before the end of the 12 month listing period and payment must be made on or by this end-date if listing a property/properties is to continue for the following 12 month period. We reserve the right to suspend a listing until payment has been made and will archive a listing if payment is not made by 14 days after the due date.

Refunds

We provide an online listing service and no refunds are available during the one-year subscription period due to administration costs and time.

Termination

Either party may terminate the agreement at any time by giving written notice to the other party.
The agreement will terminate automatically if advertisers fail to pay subscription fees by due dates.
Either party may terminate the agreement immediately by giving written notice if the other party fails to meet the terms of the agreement.
No breach will be waived without the written consent of the party not in breach.
We are entitled to remove your listing without notice for the following reasons:
o Your listing contains inaccurate or misleading information.
o We receive legitimate serious complaints about your property.
o Instances of inappropriate, unprofessional, abusive or unreasonable behaviours towards users of our site or staff.
o Your refusal to comply with these terms and conditions.

Intellectual Property

All intellectual property, logos, design, trademarks, database rights, copyright and published material/content on our sites belongs to us.
Accessible Holiday Escapes does not grant permission to the advertiser to use website content.
You may download material for the purposes of using our site but must not copy, modify, duplicate or use our content for your own purposes without prior written consent.

The limits of our liability

We provide an online advertising service through which holiday property owners or managers can advertise properties to website users. We make no guarantees about the capacity of any users to make bookings with you.
We do not enter into contracts, booking or transaction agreements between owners/managers and users.
We do not enter into complaints or disagreements between owners/managers and users.
We are not liable for any loss of profits or income due to entering into a direct agreement of users of Accessible Holiday Escapes.
We are not liable for any loss of business, contracts or commercial opportunities.
We are not liable for any damage to the property, or loss/damage of items within the property.
We are not liable for any accidents or incidents which occur at the property.
We are not liable for any damage to goodwill or reputation.
We are not liable for the failure of any user of our site to comply with the terms within your agreement with them. This includes failure to provide payment as agreed within your agreement.
We are not liable for any loss or damage to data or information, including content stored on the website.
We are not liable for enquiries blocked due to the owner/managers spam filters.
We cannot guarantee that all advertisements will receive enquiries or subsequent bookings or that payment will be made by users.
We are not responsible for making records of enquiries or subsequent bookings.

The listing/content

You are solely responsible for material you submit to Accessible Holiday Escapes for the purposes of creating your listing. This includes text, photos, contact details and video tours, and you must own copyright for this content.
We reserve the right to use images provided to Accessible Holiday Escapes in our social media content and on our website (i.e. as homepage images, images on specific pages).
You are required to provide all the information which is reasonably required to create a suitable listing. Owners/managers should ensure that:
o All information is accurate and clear.
o It does not contain links to inappropriate content.
o Photos do not contain any identifiable individuals without written consent.
o They promptly contact Accessible Holiday Escapes to make amendments if content becomes inaccurate.
By submitting this content you are granting us permission to display this content on Accessible Holiday Escapes and to modify or display content as applicable.
You are not permitted to enter programming code into your content.
The agreement will be activated upon Accessible Holiday Escapes receiving payment by which they also consent to the T’s and C’s (see invoices for details), the advertiser accepting the terms and conditions, appropriate content being provided by the owner/manager, and payment being made to Accessible Holiday Escapes for the first 12-month period of subscription.
This agreement will continue for the 12-month period unless terminated in writing by either party.
You will be provided with the draft listing prior to its ‘Go Live’ date to ensure all information is included.
Following receipt of all content, permissions, approval of listing and payment; Accessible Holiday Escapes will endeavour to place the live advertisement on the website within a reasonable period of time (not exceeding 30 days).
If the property is temporarily unavailable Accessible Holiday Escapes must be informed of this so that a listing can be suspended. If the property is permanently unavailable the owner/manager must notify Accessible Holiday Escapes in writing so that it can be removed from the website.
When owners/managers wish to make amendments to listings during the period of advertising, they must contact Accessible Holiday Escapes and these changes will be made within a reasonable time period.
It is the owner/managers responsibility to monitor and respond to enquiries made about the property.
By agreeing to these terms and conditions advertisers are giving permission for third party testimonials to be included within the listings.

Internet security

As an online business we have no control over the global network of the internet. However we take website security very seriously and take all reasonable steps to ensure the safety of Accessible Holiday Escapes for all users.
We recommend you take reasonable precautions when making online transactions.
Access to our website may be restricted without notice due to maintenance or system failure.

Legal

Any dispute, claim or other matter which arises in relation to an agreement to your booking with an owner will be governed by British law and you agree that any dispute will be dealt with exclusively by the courts.

Entire agreement/general

By requesting membership of Accessible Holiday Escapes you are confirming that you agree to these terms and conditions. These terms and conditions constitute the agreement between all parties.
This agreement is made for the benefit of all parties and is not intended to benefit any third party. Decisions to terminate or amend listings are not subject to the consent of a third party.
